Welcome to Project Jetstream! These Terms and Conditions ("Terms") govern your access to and use of the Project Jetstream mobile application and website (collectively, the "Service") provided by Project Jetstream Inc. ("Company," "we," "our," or "us").

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROJECT JETSTREAM INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE (12) MONTHS, WHICHEVER IS GREATER.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Tennessee.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute"), you agree to first contact us at coby@projectjetstream.com to attempt to resolve the Dispute informally.

If the Dispute cannot be resolved informally within thirty (30) days, the parties agree to attempt to resolve the Dispute through mediation administered by a mutually agreed-upon mediator in Tennessee. If mediation is unsuccessful, either party may pursue litigation in the state or federal courts located in Tennessee.

Class Action Waiver

You agree that any proceedings to resolve Disputes will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Project Jetstream Inc. regarding the Service and supersede all prior agreements and understandings, whether written or oral.
